POS Terms & Conditions
1. Customer acknowledges that it will receive Point of Sale System (s) ("POS") as described on the invoice as a Base Package under the following terms and conditions, any additional equipment/service shall be in accordance with the same terms and conditions;
2. Products and Services of True Biz Partner, Inc.("TBP")
- POS Hardware ("Equipment") includes POS main computer, touch screen, printers, scanners, monitor, displayers, and attachments to other POS equipment. One(1) year manufacture warranties are implied in all of our sales of equipment. Customer has options to purchase extended warranties or maintenance services separately.
- POS Software License. Customer will have a non-exclusive, non-transferrable license to use POS software program . Customer shall install and use one copy of Software on a single device. This license may not be shared or used concurrently on different devices. Customer will only have a license subject to the terms of this T&Cs; TBP reserves and retains all rights not extended hereunder. This license is not a license of any trademarks, service marks, trade names, or logos, and does not include any software other than POS Software (b) This license does not include any rights to manufacture, copy, sublicense, distribute, transfer or otherwise dispose of any copies of POS Software. Nothing contained in this T&Cs shall give customer any ownership interest, or title to, POS Software, source code, and the related documentation (including any adaptation of copies). Customer has no right to create derivative works, enhancements or modifications to POS Software.
- Training. TBP provides basic uniform training to customers about how to use POS equipment and software program at TBP's showroom or training center regularly by as low as $300 up to 2 persons per customer. Customized training is also available with reasonable prices. The customer should make appointment at least 3 business days advance.
- Onsite Installation. Once customer purchases onsite installation service and confirms that POS is working properly at customer's premises, this service is finally rendered and No obligation remains.
- Data input. Customer may ask TBP to input customers data (for example, restaurant menu, retail sales items) to POS system. Data accuracy is customer's responsibility. TBP works according to customer's initial order. Additional requests are considered as separate orders and may increase costs and time.
- Maintenance Service. This contract is not mandatory but strongly recommended. Without this Contract, TBP shall not be obligated to provide any on-going maintenance service for the customer. Notwithstanding anything to the contrary contained in this Terms & Conditions("T&Cs"), TBP reserves the right not to provide support as set forth in this T&Cs if the customer fails to install the required software for remote technical support. Regardless of service contract, TBP HAS NO OBLIGATION TO PROVIDE CUSTOMERS WITH UPGRADES OR NEW VERSIONS OF SOFTWARE.
TO BE CLEAR, each item is independent product or service. Purchase of one item does not include others.
3. MAINTENANCE SERVICE FEE and/or Software License fee. CUSTOMER AUTHORIZES TBP MONTHLY TO DEBIT FROM THE BANK CCOUNT or CHARGE TO CREDIT CARD, AS AGREED ON CONTRACT.
4. RETURN POLICY
- Unless noted separately, most products can be returned directly to True Biz Partner, Inc. within 14 days from the date of invoice if all of the following requirements are met. Please allow 2-4 weeks to process refunds. We do not accept returns of Print heads, Media (labels, ribbon, receipt paper, etc.), Software or Service Contracts. For certain items all sales are final and returns are not available, see product descriptions for information. True Biz Partner, Inc. does not accept returns on special order products. These are products which are not listed on the site for purchase. Scale and Bar code Printers are Non-Returnable.
- To receive refund, all products must 1) be returned in their original packaging, 2) include all manuals, cables, etc., 3) be resealed in a factory fresh condition. If a product shows signs that the entire product and packaging was removed from its original box, a refund may be denied. Customer is responsible for shipping costs on returned items. If the returned item meets all the above requirements, it will be accepted and a restocking fee of 20% of Sales Value of products will be applied.
- All professional services, including custom programming, card printing, label printing, menu input, training, and installation are non-refundable.
5. Sales Taxes
- California State Law requires True Biz Partner, Inc. to charge state sales tax to taxable sales, when we deliver to customer in California, regardless of customer's business address.
- Resellers with proper documentation may have tax exempt from their orders.
- If you order out-of-California and we deliver to out-of-California, we may not charge California Sales tax.
6. DISCLAIMER OF WARRANTIES AND LIMITATION OF WARRANTIES. Except as specifically set forth in this T&Cs, TBP, its Parents, subsidiaries, successors, and assigners, make no warranties, express or implied as to any service, related equipment, software, or documentation. The warranties set forth herein are in lieu of all other warranties, express or implied, which are hereby disclaimed and excluded by TBP, including without limitation any warranty of merchantability or fitness for a particular purpose or use. TBP does not guarantee that the equipment, software, or contained therein will satisfy customer's requirements, or that the operations of such will be uninterrupted or error free. Except for express warranties stated herein, if any, the equipment, software, and services are provided with all faults and the entire risk as to satisfactory quality, performance, accuracy, and effort will be with the customer. TBP shall not be liable for any costs or for performing any services hereunder arising in connection with customer's negligence, abuse, misuse, or failure to perform routine maintenance and standard operating procedures.
